The IP was acting as a liquidator of a CVL where the director’s loan account had formed the basis of a bankruptcy petition. A bankruptcy order had now been made against the director (who was continuing to dispute the sums due). Can the IP act as trustee in bankruptcy, given that he was also the petitioner, as liquidator of the company?
